Terms of use

These terms govern the public site and the initial contact process with PuntoStack. Terms for a specific project are agreed separately and take precedence if they conflict with this page.

1. Acceptance of these terms

By accessing or using puntostack.com, submitting a form, requesting a quote, or using its public features, you are subject to these Terms of Use where applicable. If you disagree, do not use features that require your acceptance.

These terms primarily govern the public site and the initial contact process with PuntoStack. A specific project may later require a proposal, scope, work order, contract, or other specific terms.

2. About PuntoStack

PuntoStack is a technology services brand operated from the Dominican Republic.

Services may be provided directly by its owner or, where applicable, through the legal entity identified in the relevant proposal, invoice, or agreement.

PuntoStack offers web development, applications, automation, integrations, SEO, e-commerce, maintenance, support, and other digital solutions. Availability, features, and scope are determined for each project.

3. Using the site

The site presents PuntoStack's services, enables enquiries, and receives requests about projects and other matters. You can browse public content without creating an account.

PuntoStack does not offer public account registration. Internal administrative features have restricted access. Client portal access is provided by invitation where appropriate.

The cookie notice is separate from these terms. You can browse without pressing Accept; analytics only starts after acceptance and with a valid configuration.

4. Forms and requests

When submitting a form, you confirm that the information is reasonably accurate and that you have permission to share it.

Submitting a request does not automatically secure project acceptance or reserve availability. Each request may be assessed for scope, feasibility, availability, and fit with PuntoStack's services.

We may ask for additional information before preparing a proposal or confirming that we can proceed.

Service request forms should be used by people able to provide the requested information or with the appropriate authorization. If you are a minor, use these features with permission from your parent or legal guardian where required.

5. Reviewing requests

Some requests require more information before we can assess feasibility or prepare a proposal. Providing that information does not itself create a contractual relationship or guarantee acceptance of the project.

6. Quotes, proposals, and agreements

Prices, timelines, deliverables, and scope are determined case by case. Published starting prices are not a fixed quote for every project.

An estimate, conversation, or initial response is not a definitive contractual offer. Specific terms may be set out in a written proposal, scope, work order, contract, or other agreement.

If a specific agreement conflicts with these general terms, the specific agreement takes precedence for that project.

Post-launch services, including maintenance, support, adjustments, improvements, or further development phases, may be governed by the original proposal, a renewal, or a subsequent agreement, as appropriate.

7. Payments

Payment terms, deposits, milestones, invoicing, and available payment methods will be communicated in the relevant proposal or agreement.

If the site enables direct payments, the payment provider's terms may also apply.

Do not send full card numbers, security codes, or other sensitive payment information through general forms.

8. Communications

By providing contact information in a request, you authorize PuntoStack to use it to respond, assess the project, request additional information, and continue related communications.

This does not automatically subscribe you to bulk advertising communications.

9. Your responsibilities

When using PuntoStack, you agree not to:

  • Deliberately submit false information or impersonate someone.
  • Use the site for illegal, fraudulent, or abusive activities.
  • Attempt to bypass access controls, authentication, usage limits, or other security measures.
  • Conduct penetration tests or exploit the site without authorization.
  • Introduce malware or share third-party data obtained without permission.
  • Use malicious automation or generate unsolicited bulk requests.
  • Send sensitive information that is unnecessary to address your request.

10. Site intellectual property

Unless stated otherwise, the PuntoStack brand and the site's original text, designs, components, illustrations, code, and other materials belong to PuntoStack or are used under appropriate licenses or permissions. Third-party materials remain the property of their respective owners.

You may view public content to learn about our services and share links to the site. This does not grant a license to substantially reproduce PuntoStack's brand, design, content, code, or graphics.

11. Client materials

Text, images, trademarks, files, credentials, and other materials provided for a project remain the property of their owner or the person entitled to use them.

By providing them, you authorize PuntoStack to access, store, reproduce, or use those materials only as necessary to assess the request or carry out the agreed project.

You are responsible for holding the necessary rights or permissions for materials you provide.

12. Ownership of deliverables

Ownership of code, designs, documentation, content, licenses, or other client deliverables will be determined in the proposal or agreement for each project.

These terms do not replace the intellectual property arrangements required for a specific engagement.

13. Third-party tools and services

PuntoStack may use external providers for hosting, security, communications, analytics, storage, and other functions needed to operate the site.

Those providers may have their own terms, policies, and availability.

Information about data processing, relevant providers, and tracking technologies is explained in our Privacy policy.

14. External links and services

The site may link to pages, platforms, or services operated by third parties. PuntoStack does not control their content, availability, security, or policies. Including a link does not necessarily imply endorsement or responsibility for that service.

15. Availability and changes

We aim to keep the site available and functional, but do not guarantee uninterrupted availability, a complete absence of errors, or that every feature will remain unchanged indefinitely.

We may correct errors, improve interfaces, update content, change features, or carry out maintenance.

16. Service results

Results also depend on factors outside PuntoStack's control. Unless expressly agreed, we do not guarantee:

  • Specific positions in Google or other search engines.
  • A particular number of sales, customers, conversions, revenue, or business results.
  • Permanent compatibility with third-party services.
  • Absolute 100% availability.

17. Security and credentials

If a project requires access credentials, appropriate sharing methods will be established. Do not send passwords, private keys, tokens, production secrets, or sensitive credentials through general forms unless a specific procedure has been established.

PuntoStack may restrict malicious, abusive, or security-threatening interactions.

18. Reasonable limitation of liability

To the extent permitted by applicable law, PuntoStack is not responsible for indirect losses, interruptions attributable to external providers, misuse of the site, or decisions based solely on general information published on it.

This provision does not limit rights or responsibilities that cannot legally be excluded or limited. Responsibilities for contracted projects may be addressed specifically in the relevant agreement.

19. Restriction or termination of access

We may restrict features when necessary for security, abuse prevention, fraud, malicious use, or applicable obligations.

Ending access to the site does not alter valid obligations under project agreements that remain in effect.

20. Privacy

Our Privacy policy explains the processing of personal information associated with using PuntoStack.

21. Applicable law

These terms are generally interpreted under the applicable laws of the Dominican Republic, unless mandatory rules applicable to a particular person or relationship require otherwise.

Before starting a formal dispute, the parties may try to resolve concerns in good faith through our contact form, where reasonable.

22. Changes to these terms

We may update these Terms of Use as our services, processes, or operational needs change. The current version shows its update date.

Specific proposals and agreements continue to govern existing projects where applicable.
